British Airways (BA, London Heathrow) has reached a settlement in a class action lawsuit brought forward in the United States regarding fuel surcharges applied to tickets purchased by loyalty programme members using their collected miles (Avios).
According to a filing with the US District Court for the Eastern District of New York, both parties agreed to adopt the previously reached settlement and requested to close the case.
The plaintiffs alleged that BA breached the terms of its loyalty programme Executive Club contract by imposing additional fuel surcharges on all tickets purchased with Avios. BA did not admit wrongdoing and claimed that the Executive Club contract allowed for such levies.
According to the terms of the settlement, all US resident Executive Club members with a valid US address who redeemed frequent flyer miles for an award ticket from November 9, 2006 through April 17, 2013 and who paid a BA-imposed fuel surcharge are now eligible to receive either between 12,500 and 35,000 Avios credited to their account or receive a cash compensation amounting to 16.9% of the paid fuel surcharges.
