The Twenty-Fourth Federal Civil Court of São Paulo issued a second injunction on December 20 blocking the proposed takeover of the civilian part of Embraer by Boeing.

"The judge ... granted a provisional measure to suspend "any action to consummate the transaction of the transfer of the commercial portion of Embraer" until the parties have had the chance to respond, at which time the Court, through the examination of the content of the responses, shall be able to better assess the case," the Brazilian manufacturer said in a statement.

Embraer said that it will seek to revert the judgement through all available judicial means.

The injunction was issued in a case brought by a labour union at Embraer.

The verdict came shortly after the two manufacturers agreed the terms of the takeover, wherein Boeing would take an 80% stake in the new joint-venture for USD4.2 billion.

The same court previously blocked the takeover after four left-wing MPs brought a case. However, the initial ruling was overturned by a higher instance court shortly afterwards.
