ACG Air Cargo Germany (Frankfurt Hahn) has unofficially gone out of business according to a report by Germany's Rhein Zeitung after the German Civil Aviation Authority, the LBA, revoked ACG’s operating permit, citing "apparent non-compliance of ACG with European Community Directive 1008/2008." The directive allows an authority to revoke an operator's permit should it find grounds that it cannot financially sustain itself for a 12-month period. Possible, but unviable solutions have included a proposed take-over, though in this case, the LBA believes 49% shareholder, Russia's Volga-Dnepr Airlines (VI, Ulyanovsk Vostochny), "will not be able to increase its stake without ACG losing rights to be registered as a carrier within the EU." The EU has a 49% ownership cap on EU-registered carriers over which, the airline would fail to be recognized as "European" thereby forfeiting its operational privileges. Another possible solution would be to increase the airline's capital but this has been dismissed as requiring all shareholders to contribute, otherwise shares would be diluted. ACG has yet to issue an official statement regarding its operational status.
