FlySafair (FA, Johannesburg O.R. Tambo) has reapplied for an air services licence from the Air Services Licensing Council of South Africa after recently concluding a black economic empowerment (BEE) deal with its employees. However, Comair (South Africa) (Johannesburg O.R. Tambo) has once more objected to the move, having successfully overturned a previous ASLC decision granting FlySafair a licence on the grounds that it did not satisfy South African laws that cap foreign ownership of a domestic carrier at 25%. BusinessDay reports that FlySafair has since then adjusted its ownership structure to exclude former shareholders, and chosen a South Africa-registered holding company as another shareholder. FlySafair reportedly informed Comair that it intends to withdraw from their court case in order to reapply for a new licence. At present, the nascent LCC is still in possession of a scheduled domestic passenger service (S1) licence though South African legislation forbids it from holding two.
