Korean Air (KE, Seoul Incheon) and Asiana Airlines (OZ, Seoul Incheon) have filed separate administrative lawsuits with the Seoul High Court to overturn enforcement fines totaling KRW6.5 billion won (USD4.5 million). The carriers are reportedly challenging a December 2025 decision by the Korea Fair Trade Commission (KFTC) regarding breached merger condition in relation to capacity guarantees.
The regulator imposed the penalties after the airlines operated at 69.5% of 2019 seat capacity on the Seoul Incheon-Frankfurt International route between December 2024 and March 2025, violating a mandate to maintain at least 90% supply. Korean Air faces a KRW5.9 billion (USD4.1 million) fine, while Asiana was fined KRW580 million (USD405,000).
