The Moscow Court of Arbitration has dismissed a USD61.5 million claim filed by MetroJet (Russian Federation) (Moscow Domodedovo) against TUI Russia unit, TT-Travel, for unlawful termination of contract.
The two parties had signed a three-year contract in February 2012 wherein Metrojet operated charter flights from Moscow to Turkey, Egypt, Bulgaria, Spain, Greece, Montenegro, and Croatia for and on behalf of the tour agency through to March 2015. However, TT Travel cancelled the deal in August last year citing an inability to agree on the terms of the partnership.
According to Russia's RIA news agency, Metrojet subsequently sued the firm claiming unlawful termination of contract adding that it had suffered substantial losses as a result of the three A321-200s allocated for TT Travel's use now standing idle. The tour operator disputed this noting that the aircraft continued to operate revenue flights for the airline.
Despite this case's dismissal, Metrojet still has several outstanding suits against TT Travel pending including one currently before a Moscow Court of Appeals for USD12.6 million in losses.
