Pretoria High Court has struck the application of Broad-Based Black Economic Empowerment (B-BBEE) Act criteria when adjudicating licence applications for international carriers operating in South Africa, in a June 5 order. A legal challenge was first filed in September 2025 by business advocacy group Sakeliga, claiming that the International Air Services Council (IASC), the country’s aviation regulator, was in breach of its authority by subjecting foreign airlines to local B-BBEE requirements. The IASC withdrew its opposition to the case in February 2026.
