The United States Court of Federal Claims dismissed on November 21 a protest filed by Aery Aviation (FST, Newport News) challenging the United States Navy's decision to award Phoenix Air (PH, Cartersville) a Contracted Air Services (CAS) contract for Electronic Warfare (EW). In June 2024, the Navy selected Phoenix Air's USD165 million proposal, which covers 10 contractor-owned and operated aircraft providing up to 5,000 flight hours of threat-simulation services. In the protest, Aery Aviation argued that it had submitted a bid nearly USD36 million lower and would have secured the award had the Navy conducted the past-performance evaluation in full accordance with the solicitation requirements.
