The Supreme Court of the State of New York dismissed on December 3 a 2023 lawsuit filed by Wheels Up (WUP, Teterboro) which alleged that flyExclusive (JRE, Kinston) wrongfully terminated a contract for guaranteed flights. The court ruled it lacked jurisdiction, noting that flyExclusive is based in North Carolina and was neither formed nor maintains an office in New York. The dispute involved USD37.5 million in deposits under a guaranteed revenue program running through March 2024. Wheels Up claimed flyExclusive abruptly ended the agreement during a busy holiday weekend, while flyExclusive contended that Wheels Up was in default. The lawsuit was dismissed without prejudice, allowing Wheels Up to refile. Both companies declined to comment.
